1. Website Use

You must be legally capable of entering into a binding agreement to make a purchase. If you use our website on behalf of an organization, you confirm that you are authorized to act on its behalf.

You agree to use our website lawfully. You may not interfere with its operation, attempt unauthorized access, submit fraudulent information, introduce malicious software, or infringe the rights of others.

2. Account and Customer Information

You agree to provide accurate and complete information when placing an order, creating an account, or contacting us. This includes your contact details, shipping address, and payment information.

If you create an account, you are responsible for protecting your login credentials. Please notify us promptly if you suspect unauthorized access.

3. Product Information and Availability

We work to provide accurate product descriptions, images, pricing, and specifications. However, errors may occur. Product colors may appear differently depending on your screen settings.

Products are subject to availability. We may update product listings, change prices, or discontinue products. Changes do not retroactively alter accepted orders unless we contact you and obtain your agreement or cancel and refund the order as permitted by law.

Kit contents, optional accessories, and included equipment are identified in the applicable product listing. Please review your selected variant before purchasing.

4. Orders, Pricing, and Payment

Unless otherwise stated, prices are listed in U.S. dollars. Applicable taxes and shipping charges are displayed at checkout.

An order confirmation acknowledges receipt of your order and does not necessarily constitute acceptance. We may decline or cancel an order because of unavailable stock, a material pricing or listing error, suspected fraud, or another legitimate reason.

If we cancel an order after payment has been collected, we will refund the amount paid for the canceled items, including applicable taxes and shipping charges attributable to them.

Promotional offers are subject to their stated conditions and expiration dates.

5. Shipping and Delivery

Orders are generally processed within 1–2 business days. Processing may take longer during holidays or periods of high order volume.

Delivery estimates are not guaranteed and may be affected by carrier delays, weather, or other circumstances.

We ship to APO/FPO addresses. Shipments to Alaska, Hawaii, and U.S. territories are sent through USPS and may require additional delivery time.

You are responsible for providing a complete and accurate shipping address. If your shipment arrives damaged or you experience a delivery issue, contact info@everlitsurvival.com so we can help resolve it.

6. Cancellations, Returns, and Refunds

You may request cancellation before your order ships. Orders canceled before shipment are eligible for a full refund.

Unless designated as non-returnable, eligible products may be returned within 60 days of delivery in new, unused condition with original tags attached. Returns of products with opened or used contents may not be accepted.

Contact info@everlitsurvival.com to arrange a return or exchange. Approved refunds are issued to the original payment method after the returned product has been received and inspected.

7. Product Use and Safety

Our products include first aid, medical, survival, and emergency preparedness supplies. Website descriptions and educational content provide general product information and are not a substitute for professional medical advice, emergency services, or appropriate training.

Follow the manufacturer’s instructions, warnings, storage requirements, and expiration dates. Certain trauma care products require training for proper use.

In a medical emergency, contact emergency services immediately. A first aid or trauma kit does not guarantee a particular medical outcome.

8. Product Warranties

Applicable product warranties are governed by our published Warranty Policy and any additional warranty terms provided with the product.

Nothing in these Terms excludes or limits an express warranty we provide or any consumer rights or warranties that cannot legally be excluded.

9. Intellectual Property

Website content, including EVERLIT branding, logos, text, photographs, graphics, and videos, belongs to EVERLIT or its licensors and is protected by applicable intellectual property laws.

You may view and use this content for personal shopping purposes. You may not reproduce, distribute, modify, or commercially use it without permission, except as permitted by law.

Third-party trademarks remain the property of their respective owners.

10. Reviews and Submissions

If you submit a review, photograph, or other content, you confirm that you have the right to share it and that it does not contain unlawful, misleading, or infringing material.

You grant us a nonexclusive, royalty-free license to display and reproduce that content in connection with our website and product marketing. Any use remains subject to applicable privacy and publicity rights.

We may remove content that violates these Terms. We do not require positive reviews or prohibit honest negative feedback.

11. Third-Party Services and Links

Our store uses Shopify and other providers to support services such as checkout, payments, and shipping. Our website may also link to third-party websites.

Third-party services may have their own terms and privacy policies. We are not responsible for the content or practices of independently operated websites.

13. Website Availability and Liability

We make reasonable efforts to maintain our website, but we do not guarantee uninterrupted or error-free access.

To the extent permitted by law, EVERLIT is not liable for indirect or consequential losses arising from use of the website. This provision does not limit liability for fraud, willful misconduct, personal injury caused by negligence, or any liability that cannot legally be excluded or limited.

These Terms do not reduce your rights under applicable consumer protection laws or our express product warranties.

These Terms are governed by the laws of California, United States, except where applicable law requires otherwise.

Nothing in this provision deprives you of mandatory consumer protections available under the laws that apply to you.
